    When should I file a mechanics’ lien claim?

    • Both general contractors (i.e., has a direct contract with the owner), and subcontractors must file a mechanic’s lien affidavit by the 15th day of the fourth calendar month after the indebtedness accrues. 
    • If you are a subcontractor who was hired by the general contractor, you will also have to provide certain notices to the general contractor and the owner depending on when the original contract was entered into. 
    • Different rules apply if the project was residential.
